Terms of Service & End-User License Agreement

Welcome to woobaba.dev. Please read these Terms of Service and End-User License Agreement ("Terms", "Agreement", or "EULA") carefully before purchasing, downloading, installing, or utilizing the WooBaba 3D Gallery Store software, extension packages, or associated web services (collectively referred to as the "Software" or "Services") provided by WooBaba ("we", "us", or "our").

By purchasing a license, downloading the plugin archive, or activating a license key on any website, you ("Customer", "Licensee", or "User") agree to be legally bound by all terms, conditions, disclaimers, and operational policies set forth herein. If you do not agree with this Agreement in its entirety, you are strictly prohibited from downloading, installing, or utilizing our software.

1. Software Licensing & Scope of Use

Upon receipt of full payment, WooBaba grants you a revocable, non-exclusive, non-transferable, worldwide license to deploy and execute the Software strictly under the following parameters:

• Single Production Domain Allocation: Each standard commercial license purchased entitles the Licensee to activate and run the Software on exactly one (1) live production top-level domain (e.g., yourstore.com or a dedicated subdomain).
• Staging & Local Development Environments: You are entitled to activate the license on unlimited non-production development environments (such as localhost, *.local, *.test, or staging.yourstore.com) strictly for testing and pre-deployment inspection without consuming your single-production allocation.
• License Key Binding & Telemetry: Each license key is bound to the verified production domain record on our licensing server. Transfers to an alternative production domain may be performed directly through your Client Dashboard or upon request to our support engineering team.
• Strict Usage Prohibitions: You may not redistribute, sublicense, resell, lease, rent, broadcast, share, or publish the plugin ZIP archive or your private license keys on public repositories, GPL redistribution clubs, or unauthorized third-party platforms.

2. License Duration, Updates & Annual Renewals

• Subscription Term: Unless a lifetime license tier is explicitly designated during checkout, all commercial licenses remain valid for a term of one (1) full calendar year (365 days) from the initial date of purchase.
• Entitlement to Updates & Security Fixes: An active license grants you immediate in-dashboard automatic updates, architectural performance upgrades, bug patches, and compatibility releases with newer WordPress and WooCommerce core versions.
• Expiration & Renewal Terms: An annual renewal fee is required to maintain access to automated remote updates, licensing server validation, and priority technical support. If a license expires, the existing deployed 3D gallery functionality will continue operating on the bound domain, but update channels and technical assistance will be suspended until renewed.

3. Orders, Pricing & Cryptocurrency Settlements

• Currency & Price Adjustments: All product prices displayed on the Website are denominated in United States Dollars ($ USD). WooBaba reserves the right to modify licensing prices or introduce new feature tiers with prior notice on our catalog.
• Cryptocurrency Payments: Payments settled via our integrated cryptocurrency payment infrastructure (such as NOWPayments) are processed across decentralized blockchain networks. Transactions are deemed complete upon receiving the requisite number of network confirmations.
• Network & Miner Fees: Any gas fees, miner fees, or exchange processing charges incurred during cryptocurrency settlement are the sole responsibility of the buyer and are non-refundable.
• Order Fulfillment: Software download links and cryptographic license keys are provisioned and delivered automatically to your Client Dashboard immediately following confirmed blockchain settlement.

4. Refund Policy (Digital Goods & Technical Guarantee)

Due to the irrevocable, non-tangible nature of downloadable digital software and instant provision of source files and license keys upon purchase, all commercial sales are generally final.

However, we stand behind the architectural quality of WooBaba and offer a conditional 14-Day Technical Resolution Guarantee:

• Eligibility Criteria: If you encounter a verifiable technical defect, fatal script error, or WebGL rendering failure that prevents the Software from functioning on a verified compatible hosting environment, you must open a ticket with our engineering team within fourteen (14) calendar days of purchase.
• Resolution Process: You agree to provide our support team with reasonable technical diagnostic context (such as browser console logs, WooCommerce system status reports, or temporary staging access) to diagnose and resolve the conflict.
• Discretionary Refund/Credit: If our engineering staff confirms that the Software cannot function as documented on your compatible environment and our team is unable to provide a fix within a reasonable timeframe, a refund or store credit will be issued.
• Non-Refundable Circumstances: Refunds will not be issued for lack of WebGL support on the client's obsolete hardware, changing of mind post-download, refusal to provide diagnostic logs, or server environments that fail our documented minimum hosting requirements.

5. System Requirements & Compatibility Limits

The Licensee acknowledges and agrees that optimal execution of the 3D gallery engine requires adherence to our baseline environment specifications:

WooBaba does not warrant seamless operation on legacy web browsers (such as Internet Explorer), heavily restrictive shared hosting environments with severe memory limits (below 256MB PHP memory limit), or environments running corrupted third-party scripts that violate WordPress API conventions.

6. Technical Support Policy

• Coverage: Active license holders are entitled to priority technical support for installation inquiries, license authentication issues, plugin bug reports, and general configuration assistance.
• Support Channels: Support is delivered exclusively through our official Client Dashboard Support Desk. We do not provide real-time phone support or live social media troubleshooting.
• Exclusions: Technical support does not cover bespoke theme code modification, deep custom JavaScript/WebGL shader alterations, third-party plugin conflict resolution outside standard WordPress API compliance, or server-level server management.

7. Intellectual Property Rights

All title, intellectual property, copyright, source code, custom WebGL/Three.js algorithms, shader scripts, design layouts, graphics, documentation, and trademarks associated with WooBaba are and shall remain the exclusive property of WooBaba. Your purchase grants you a license to use the Software as specified; it conveys no proprietary ownership or intellectual rights in the underlying software.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WOOBABA HEREBY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, COMPLETELY ERROR-FREE, OR COMPATIBLE WITH EVERY COMBINATION OF THIRD-PARTY EXTENSIONS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WOOBABA, ITS FOUNDERS, DEVELOPERS, AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, COMMERCIAL PROFITS, BUSINESS REPUTATION, DATA LOSS, LOSS OF STORE TRAFFIC, OR SERVER DOWNTIME ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SOFTWARE.

IN ALL CASES, THE TOTAL AGGREGATE LIABILITY OF WOOBABA ARISING OUT OF OR RELATING TO THIS AGREEMENT SHALL BE STRICTLY LIMITED TO THE ACTUAL AMOUNT PAID BY THE CUSTOMER FOR THE SPECIFIC SOFTWARE LICENSE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT.

10. Termination of License

This Agreement is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any term of this Agreement (including unauthorized distribution of license keys or reverse-engineering). Upon termination, you must immediately cease all use of the Software and delete all copies of the plugin from your servers.

11. Amendments & Contact Information

We reserve the right to revise or replace these Terms at our discretion. Any material changes will take effect immediately upon publication with an updated effective date. Continued usage of our services following published modifications constitutes full acceptance of the revised terms.
